The US Supreme Court decision in the matter of Eldred v Ashcroft (January 15th 2003) held that the amendments made in 1998 to the US Copyright Act which extended the term of copyright to life plus 70 years, from life plus 50 years, were not unconstitutional and were valid. The Court discarded the argument that copyright protection should be restricted to the term of copyright that was effective at the time the work was produced, therefore giving the amendments a retroactive effect.

An Australian company that conducts business online should acquire a clearance to use material on their website that is out of copyright in Australia but is still protected in the US as it will be accessible in the US.

It has not yet been resolved whether a court will take jurisdiction in regards to material used in websites hosted in other countries therefore a company that conducts business online should seek legal advice regarding their liability and the risks of legal action in relation to the impact of this decision.
